Important Considerations of This Policy:

• This Brand Use Policy (this “Agreement”) is part of my “Terms of Service,” which is a Legal Agreement between You and ELE HARRIS (“eleharris.com”) regarding the terms under which the Website will provide the Subscriber access to the Service.
• By visiting our Website and/or purchasing anything from us, you contract our “Service” and agree to be bound by the terms and conditions (“Terms of Service,” the “Terms”), including any additional terms and policies referenced herein and/or available here through links.
• These Terms of Service apply to all users of the Website, including, without limitation, users who are browsers, sellers, suppliers, customers, consumers, and/or content contributors.
• If you do not agree to all the terms and conditions of this Agreement, then you may not visit the Website or use any service.
• The headings used in this Agreement are included for your convenience only and shall not limit or affect these Terms.

ELE HARRIS (“ELE HARRIS™”) considers its trademarks and the goodwill represented by such trademarks to be extremely valuable assets. Therefore, it is important that you follow these guidelines when using any of ELE HARRIS’s trademarks. ELE HARRIS will take all appropriate, necessary, and advisable legal action to preserve the strength and retain the exclusive rights to use its trademarks. As a guide and reference, the “ELE HARRIS Trademarks” include all registered and unregistered trademarks and service marks (such as words, names, symbols, devices, slogans, and any combination thereof) owned by ELE HARRIS, including, without limitation, those trademarks and service marks listed in the ELE HARRIS Trademark List.

ELE HARRIS is the exclusive owner of the “ELE HARRIS Trademarks” and reserves all rights not expressly granted here or in separate licensing agreements. Therefore, any “goodwill” derived from the use of ELE HARRIS’s trademark belongs solely for the benefit of ELE HARRIS. By using an ELE HARRIS trademark, in whole or in part, you acknowledge that ELE HARRIS is the sole owner of the trademark and you promise not to interfere with ELE HARRIS’s trademark rights, including the use of its Website, trademark registration, or application to register its trademark, alone or in combination with other words, anywhere in the world, and that you will not cause harm, misuse, or claims regarding the use of trademarks with any other website.

If ELE HARRIS has agreed to partner with you to conduct business transactions, ELE HARRIS will provide you with a brand manual that stipulates how the ELE HARRIS trademark must be used in terms of size, typography, colors, and other graphic characteristics of its trademarks, as well as other limitations or regulations you must follow when using the Website’s trademarks.

You may use the “ELE HARRIS Trademarks” to truthfully describe how your products or services relate to the products or services of the Website, provided that you follow these rules and regulations and make it clear that your products and services are not offered, sponsored, endorsed, or promoted by ELE HARRIS. See “Compatibility” below.

You may use slogans referring to the Website’s Trademarks; provided that these slogans always appear in smaller and less prominent letters than your own company’s brand name and you use different typography, colors, and graphic characteristics.

You must make the ELE HARRIS trademark distinguishable from the surrounding text in some way, such as using uppercase letters, quotation marks, and/or different typography or font from the ELE HARRIS Trademark.

You may use the ELE HARRIS trademark only in the form indicated in the brand manual and it must not be used in plural or any other modified form.

You must always use the appropriate trademark symbol, such as TM, SM, or ® as specified by ELE HARRIS and include written text in a footer indicating that the trademark belongs to ELE HARRIS and is used by you with permission and authorization from the owner. Use the following format:

“ELE HARRIS” and the “ELE HARRIS logo” are registered trademarks or trademarks of ELE HARRIS in the United Kingdom and other countries.

You must always use the ELE HARRIS Trademark as an adjective followed by a generic category name of the product or service it modifies, such as ELE HARRIS® Methodology or ELE HARRIS® Workshops. Therefore, “ELE HARRIS” functions not only as a trademark and service mark identifying its products and services but also as a trade name referring to ELE HARRIS. Trade names are nouns and therefore should not be followed by a generic descriptor and may be used in the possessive form. When used as a trade name, “ELE HARRIS” should not be followed by the trademark symbol. In documents, the first reference to the trade name should be “ELE HARRIS™.” Subsequently, “ELE HARRIS” may be used in other references.

Although ELE HARRIS does not have a registered trademark for other similar names, the use of similar terms may create confusion in the market regarding the origin, authenticity, and sponsorship of such products. Therefore, to avoid such confusion, the use of similar terms is not permitted.

Except for the logos of SPACEBIND, NEONÉTICA, and other trademarks (whose use requires a licensing agreement with ELE HARRIS), you may generally use the ELE HARRIS trademark to refer to ELE HARRIS products and services in advertising, promotion, and sales materials, provided that you have the necessary authority to sell and promote ELE HARRIS products and services, e.g., authorized reseller, licensee, etc.

You may indicate the relationship of your products and services to ELE HARRIS products and services using truthful reference phrases in connection with your products and services, such as “for use with the ELE HARRIS platform” or “compatible with the ELE HARRIS platform,” provided that: (a) the ELE HARRIS trademark appears less prominently than the product or service name; (b) the ELE HARRIS trademark is not part of or incorporated into your product or service name; and (c) the reference phrase is truthful and does not violate any requirements stipulated in the licensing agreement with ELE HARRIS.

If you become aware of any inappropriate use of any of my trademarks that are confusingly similar to the ELE HARRIS trademarks, please notify eleharris.com by sending a message through the form at the bottom of this page. Similarly, if you find any aspect of the ELE HARRIS trademark that violates any of the clauses above, including failure to identify ELE HARRIS’s trademark ownership, please report it using the same form. If possible, please include a copy of the article, publication, or media where the trademark violation appeared.

This Trademark Usage Policy (“This Agreement”), together with the Terms of Service, the Website Usage Policy, and other policies published on this Website, constitutes the sole and complete agreement between You and ELE HARRIS regarding any type of products and/or services and supersedes any prior agreements, representations, warranties, communications, proposals, and other terms, whether oral or written (including, but not limited to, any previous Terms of Service). Any ambiguity in the interpretation of this Agreement shall not be construed against ELE HARRIS, its brands, or affiliates.
